Let’s get started!

Making the most of our Next-Level Work is easy. We follow up on our work in the Legal Strategy Session, as we’ve discussed together.

While we can do everything at once if this is what you would like, most clients prefer to stage the work.

Each stage represents an important step in the journey of putting your health and wellness business on a firmer legal footing. These are building blocks toward legal protection and regulatory compliance.

At each stage, we may do one of the following:

  • Legal research
  • Write up our analysis and recommendations
  • Draft a legal document
  • Report to you by email or by phone and discuss our findings and next steps
  • Give you “homework” for things you can do on your end to move us along

Sometimes we may spend more or less time on one of these steps.

For example, sometimes we might need a lot of legal research and a write-up to manage all the complexity and clarify the action items; at other times we may want to jump on the phone early on to let you know some decisions points and business judgments you can make to move forward.

When I was a kid, my Mom, an endocrinologist on faculty at Wayne State University School of Medicine, took me on rounds with her at the local hospital.

Unfortunately, I fainted. That and my undergraduate Biology class at Columbia University ended my aspiration to become a medical doctor.  Fortunately, law school picked up where childhood study of Talmud left off: the art of asking good questions, solving thought puzzles, and analyzing text. What happens if someone’s ox gores another’s?  Those ancient questions of liability and indemnification, which I poured over as a lad, recur in today’s ever more sophisticated healthcare legal practice.  What does the law say?  How do we figure out, and implement, what is fair?  What is the best advice one can give to the ox owner?

Yesterday, an ox; tomorrow, a medical practice or a dietary supplement or cosmetic or healthcare software that is powered by artificial intelligence.

Remember that legal review normally does not produce yes/no, black-and-white answers.  Rather, a good legal analysis looks at the risk and risk mitigation.

That is why we say in our mission statement:

We do not confer a priestly blessing. Rather, we inform you about the nuances, and draft customized documents, so you can make informed business decisions and go forward.

Most of the time, our clients are thrilled.  They’ve gotten the legal advice they need and grow tremendously successful, powerful, and effective health and wellness ventures.

We excel at getting you to step up the gas and navigate effectively.

Every once in a while, based on our advice, the client decides not to pursue the business model they initially presented. And usually, this is all for the best. Often that model, without further legal refinement, would have subjected the parties involved to criminal enforcement, administrative action, and civil penalties.  There are many healthcare regulatory and legal hot buttons.  Our concern is principally with our clients’ legal well-being, as well as counseling them as to how they can tighten their model where appropriate.  We can certainly understand if such clients wish they could have moved forward without big legal risk.

And we are thrilled when the legal strategies and solutions we provide are pivotal, helping them grow in revenue and outreach.
