Why Healthcare Providers Need More Than AI and Web-Based Legal Guidance

Here’s why healthcare providers and businesses need more than AI and web-based legal guidance. Admittedly, the regulatory terrain is complex, but that in itself isn’t enough.

What is important is that every business has really unique nuances, and that’s going to affect the interpretation of the legal rules as they’re applied to your situation. So, healthcare law is not just one discreet body of law. There’s federal law, there’s state law, there’s statutes, there are regulations.

Sometimes there are policy statements by the board. Sometimes there are articles that kind of hint at trends. It’s not just the information, but it’s about knowing where to look for the information and then figuring out which information actually applies to you.

So, imagine that, for example, you’re a telehealth provider and you are looking at telehealth law. Maybe you operate in three different states. Maybe you are, in a tri-state area and you can read this stuff. But even lawyers reading this stuff, it’s hard to really, it’s not written in English. And even if you tell the AI translate in English, it doesn’t always translate because law is written in a particular way.

And the problem is, if you get it right, great, but if you don’t: trouble. And if you do or don’t, it really depends on what’s in the mind of the person looking at that rule, not in the mind of the omniscient, super intelligent technological creation. So, it might be an angry patient who’s angry ’cause of something else.

Or it could be a regulator who’s got a B in their bonnet about a particular thing. Maybe they don’t like the way the chiropractors advertise. Maybe they just don’t like chiropractic. Who knows what it is. Sometimes it’s the regulatory challenge Du jour. I muffled that because it’s like soup du jour.

Regulatory challenge du jour doesn’t exactly translate, but you get the idea. Whatever’s up for the day, that’s what they go after. Now you can do a web search and say, who are they up after today? Yesterday was medical spas. Today it’s telemedicine. Next month it’ll be mobile health. It’ll be general wellness products.

The next day it’s dietary supplements. I. There’s all sorts of threats out there in the environment, and there’s also what I call the collateral attack, meaning you could have everything as dialed down as you want it to be, but somebody comes in from the side and there’s something that they don’t like.

You haven’t plugged a hole, filled the gap, spotted the issue, anticipated, and now there are really big consequences. That’s why it’s really good to have the human judgment, maybe using the AI tools for research. But you want the human eye on your business just like you are a human running your business using tools so that you can have that unique lens and perspective, spot trouble before it arises. Get ahead of it and put things in place that are going to help protect you down the line.
